ARTICLE 1: PURPOSE AND GENERAL INFORMATION

The getynd.com website is the property of MYSTERY MERIDIAN Lda, of which GETYND is a trademark. The company's registered office is located at Rua Godinho Faria 825, 4465-156 Matosinhos, Portugal.

These General Terms and Conditions of Use (GTCU) provide a legal framework for the use of the services of the getynd.com website (hereinafter referred to as "the site").

The terms defined below beginning with a capital letter, whether used in the singular or plural, are used with the following meaning:

  • The "User": refers to any person using the site and having accepted the General Terms and Conditions of Use.

The User declares that he/she has the capacity to contract and enter into this contract, i.e. that he/she is of legal age and not under guardianship.

Application

The applicable Terms and Conditions of Use are those in force on the website at the date of use. MYSTERY MERIDIAN Lda reserves the right to adapt or modify these Terms and Conditions of Use at any time.

Access to the website constitutes a contract between MYSTERY MERIDIAN Lda and the User and must be preceded by acceptance of these GTC. Access to this platform implies acceptance of these T&Cs.

The getynd.com website is published by MYSTERY MERIDIAN Lda.

ARTICLE 3: ACCESS TO THE SITE

The website is accessible 7 days a week and 24 hours a day, subject to its closure for maintenance, repair or in the event of force majeure and any event beyond the control of MYSTERY MERIDIAN Lda.

MYSTERY MERIDIAN Lda may not be held liable for any loss or damage suffered by the User or any third party as a result of a technical failure in access to the website, the Internet network, telecommunications resources or, more generally, due to an event of force majeure, as defined by the case law of the French courts, during a visit to the website or when placing an order.

MYSTERY MERIDIAN Lda cannot be held responsible for any non-conforming use of the website by the User or any other third party.

MYSTERY MERIDIAN Lda may not be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses or disruption of service.

The getynd.com website provides free access to the following services:

  • Buying and assembling made-to-measure curtain poles
  • Purchase of curtains

The site can be accessed free of charge from anywhere by any user with Internet access. All costs incurred in accessing the services (computer hardware, Internet connection, etc.) are the responsibility of the User.

Access to member services is by username and password.

For maintenance or other reasons, access to the site may be interrupted or suspended by the publisher without notice or justification.

ARTICLE 4: DATA COLLECTION

In order to create a User account, it is necessary and compulsory to collect information when registering on the site.

MYSTERY MERIDIAN Lda undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the User's personal information from being distorted, damaged or accessed by unauthorised third parties.

  • The following data is collected on the getynd.com website:
  • When creating a customer account: surname, first name, address, telephone number and e-mail address;
  • At the time of payment: financial data relating to the bank account or credit card under secure conditions, payment institution.

The data collected is kept for a period of 5 years.

In accordance with European regulations (RGPD) and French law, the Customer has the right to access, rectify, delete, erase, port and oppose the processing or transmission to partners of data concerning him/her, which may be exercised by sending a letter with acknowledgement of receipt to the following address: MYSTERY MERIDIAN Lda, Rua Godinho Faria 825, 4465-156 Matosinhos, Portugal, giving your contact details (surname, first name, address) and, if possible, the order number.

The User's personal information is sent to and stored at the site host located in France, whose contact details are given on the site in the "Legal Information" section.

Under no circumstances will data collected on this site be passed on or used for the benefit of third parties, for commercial or other purposes.

You have the right to appeal to the CNIL.

Archiving

The computerised records of the getynd.com website are considered as proof of communications, orders, payments and transactions between them.

Electronic communications are presumed to have the same evidential value as a written document.

MYSTERY MERIDIAN Lda shall archive orders and payment receipts or invoices on a reliable and durable medium, constituting a true copy, for a period of five (5) years from the conclusion of the order, in accordance with current legislation.

MYSTERY MERIDIAN Lda undertakes to provide the Customer with access to the archived data at all times and to provide the Customer with a copy of the General Terms and Conditions of Use and/or Sale if the Customer so requests.

ARTICLE 5: INTELLECTUAL PROPERTY

The brands, logos and content of the getynd.com website (graphic illustrations, text, etc.) are protected by the French Intellectual Property Code and by copyright.

Reproduction and copying of content by the User requires prior authorisation from the site. In this case, any use for commercial or advertising purposes is prohibited.

ARTICLE 6: LIABILITY

Although the information published on the site is deemed reliable, the site reserves the right not to guarantee the reliability of the sources.

Despite regular updates, the site may not be held liable for any changes in administrative or legal provisions occurring after publication. ARTICLE 10: APPLICABLE LAW AND JURISDICTION

This contract is subject to French law. In the event of a dispute between the parties failing to be resolved amicably, recourse will be made to the competent courts to settle the dispute.
